What Happens at the DMV Hearing?
Apart from your criminal case, Colorado drunk driving cases and traffic cases may also consist of an administrative hearing before the Department of Motor Vehicles (DMV). Here it will be determined whether your driver's license should be revoked for an alcohol-related offense, traffic point suspension, or administrative reason such as insurance, traffic accidents, and the failure to pay child support. If your driver's license is revoked by the DMV, you can appeal to the state district court, where you may be able to have your license reinstated through the appeals process. Be certain to explore your legal options and remedies with an experienced attorney.
What Will Happen to Me in the Courtroom?
DUI penalties range from probation to one year in jail and may also include alcohol education and treatment, mandatory public service, and Victim Impact Panel (VIP) participation.
D. L. Demers & Associates, LLC is readily able to argue the client's case at trial or negotiate with the State in an attempt to minimize penalties, such as jail time or the loss of driving privileges. Armed with comprehensive knowledge and vast experience, they will work to build you the strongest case possible. They will also represent you at your administrative hearing before the DMV.
Habitual Traffic Offender (HTO)
A series of seemingly simple traffic offenses can quickly become a serious criminal matter. Per Colorado's three strikes rule, your driving privileges will be suspended for five years if you commit three serious traffic offenses (e.g. DUI, DWAI, reckless driving, hit and run) within a seven year period. Moreover, if you are arrested for driving under the influence (DUI) during your HTO status, you can be charged with a felony.
